Terms And Conditions Official Rules Void where prohibited 1. Eligibility: You must be 18 years or older, and a citizen and resident of Hawaii, Alaska or one of the continental United States. This free giveaway is not open to employees. Odds of winning will depend on the total number of eligible submissions received. All federal, state and local rules and regulations apply. Void where prohibited by law. 2. Your name will be entered into the contest for each paid month of web hosting services, or for each paid month of web hosting services for companies you recommend. There will not be any limitations on the amount of times your name is entered into the contest. 3. How to Enter: No responsibility is assumed for incomplete, late, illegible, lost, misdirected, technical, or mechanical malfunctions, or inaccurate entry information, weather caused by equipment, programming used, in this giveaway, human processing error or otherwise. Modomo, Inc. reserves the right and has sole discretion to void any and all entrees of an entrant whom Modomo, Inc. believes has attempted to tamper with or impair the administration, security, fairness or proper play of this giveaway. 4. Selection of Winners: The winning entry will be selected in a random drawing when Modomo Inc. obtains 2004 new web hosting accounts. The winner will be notified by phone or mail. We will also post the winners name at www.modomo.com. If the winner cannot be reached within a week of the first attempt to reach said winner, and a prize notification letter is returned as undeliverable, winner will be disqualified and an alternate winner will be selected. The winners of the free giveaway will be required to sign a waiver for "release of liability" in order to receive the prize. 5. The prize includes: Two (2) round trip air tickets to Hawaii from the nearest major airport to winner's home address, hotel accommodations and a rental car for 1 week. Estimated Value is ($5,000.00). The Hawaii Vacation prize will be good for 1 year from the winner's notification date. (Travel must be completed within one year). There are no transfers, assignments, cash redemptions, or substitutions of prize. 6. No substitutions for prizes. All federal, state, and local taxes for all parties traveling are the sole responsibility of the winner. All other expenses not specified herein are the sole responsibility of the winner. 7. Notification: Winner will be posted online at the following addresses; www.modomo.com 8. General: By entering, each participant agrees to be bound by these Official Rules and the decisions of Sponsor, which shall be final. Winners will be required to sign and return an Affidavit of Eligibility and Liability and (where permitted) Publicity Release, which must be returned within 14 days (2 weeks) of the notification attempt. By accepting and/or using prize, the winner agrees to the use of winner's picture, name, voice, and/or likeness for the purpose of advertising, trade, or promotion in any media now known or hereafter invented without further permission or compensation, unless prohibited by law. If any winner cannot be contacted, is ineligible, fails to claim the prize, or fails to return the completed and executed affidavit and releases by the deadline designated by the Sponsor, prize will be forfeited and an alternate winner selected. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the e-mail account. By entering, each participant agrees to release and hold Sponsor, its parent company, affiliates, subsidiaries, agents, and representatives and their respective advertising, promotion, and fulfillment agencies, and legal advisors, and the employees, officers, directors, and shareholders, of each, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Giveaway. Other Important Information: Modomo Inc., shall not be responsible or liable for: (i) late, lost, stolen, delayed, damaged, misdirected, incomplete, illegible, unintelligible, or postage-due entries or mail; (ii) electronic, hardware or software program, network, Internet, telephone, telecommunications or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Giveaway to be disrupted or corrupted; or (v) any printing or typographical errors in any materials associated with the Giveaway. Modomo Inc. reserves the right, in its sole discretion, to suspend or cancel Giveaway at any time if a computer virus or other technical problem corrupts the administration, security, or proper play of the Giveaway. 9. Miscellaneous: The names, logos, and icons identifying the products and services of Modomo Inc. Modomo, Inc Free Hawaii Trip Giveaway rules are subject to change at any time without notice. No waiver by Modomo Inc. of any provision of these rules shall constitute a continuing waiver. Any dispute arising under these rules shall be governed by the laws of the state of Florida without regard to its rules regarding conflict of laws, and all disputes shall be heard in the state or federal courts in Orange County Florida. If any provision of these rules is held illegal or unenforceable, the provisions not affected shall survive. The winner acknowledges and agrees that as a condition of winning, if legally permissible, Sponsor has the right to publicize his/her name, likeness, address, and fact that he/she won the Free Hawaii Trip Giveaway, and all matters incidental thereto, without further compensation.
